18 U.S.C. § 2257 Compliance Statement

Statement

Zumido GmbH ("Zumido") operates a platform that allows third-party content creators ("Creators") to upload and share content, including content that may depict sexually explicit conduct as defined under 18 U.S.C. § 2257 and 28 C.F.R. Part 75.

Platform Status

Zumido is not the primary producer or secondary producer of any content uploaded by its users. All content on the Platform is created, uploaded, and published by individual Creators who are solely responsible for compliance with 18 U.S.C. § 2257 and all applicable record-keeping requirements.

Creator Obligations

All Creators on Zumido are required to:

Complete identity verification (KYC) confirming they are at least 18 years old before posting any content
Ensure that all individuals appearing in their content are at least 18 years old at the time of production
Maintain records of age verification for all performers appearing in their content, as required by 18 U.S.C. § 2257
Provide such records to Zumido upon request and to any authorised government agency conducting an inspection
Comply with all applicable federal, state, and local laws regarding the production and distribution of content

Platform Measures

To support compliance, Zumido has implemented the following measures:

Mandatory KYC: All Creators must verify their identity with a government-issued photo ID and live selfie before they can post content or receive payments
Age gate: All users must confirm they are 18 or older before accessing the Platform
Content moderation: We employ automated and manual content moderation to detect and remove content that may involve minors
Reporting: Any suspected CSAM is immediately reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities
Zero tolerance: Accounts found to contain content involving minors are immediately terminated and referred to law enforcement

For all user-generated content, the individual Creator is the custodian of records. Questions regarding records for specific user-generated content should be directed to the Creator of that content.

Exemption

To the extent that Zumido qualifies as a provider of an interactive computer service under 47 U.S.C. § 230, and as a platform that does not produce content, certain record-keeping obligations under 18 U.S.C. § 2257 may not apply directly to Zumido. Notwithstanding, we maintain our own records as described above as a matter of best practice and commitment to child safety.
