Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of Zumido ("the Platform"), operated by Zumido GmbH, a company incorporated in Switzerland ("we", "us", "the Company"). By accessing or using the Platform, you agree to be bound by these Terms in full. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years old to create an account or use the Platform. By registering, you represent and warrant that you are of legal age in your jurisdiction and have full legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to suspend or terminate accounts where age verification cannot be confirmed.

3. Account Registration and Security

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@zumido.com of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access where you have failed to safeguard your credentials.

4. Platform Services

Zumido provides a platform that enables content creators ("Creators") to share content with fans ("Fans") in exchange for subscriptions, tips, pay-per-view payments, and other transactions. We act as an intermediary and are not a party to the contract between Creators and Fans (see our separate Contract between Fan and Creator).

5. Content Guidelines

All users must comply with our Community Guidelines. You are solely responsible for all content you post. You agree not to post content that:

Depicts, promotes, or involves minors in any context
Is non-consensual, depicts real violence, or promotes self-harm
Violates any applicable law or regulation, including Swiss federal law and EU regulations
Infringes any third-party intellectual property rights
Contains malware, phishing, spam, or deceptive material
Promotes illegal activities, terrorism, or hate speech
Contains personally identifiable information of third parties without consent

We reserve the right to remove any content that violates these Terms and to suspend or terminate the account of any user who repeatedly violates them.

6. Creator Obligations

Creators must complete identity verification (KYC) before receiving any payments. By becoming a Creator, you confirm that:

All content you share is original or you hold all necessary rights and licences
All individuals appearing in your content are over 18 and have given informed consent
You maintain records in compliance with applicable record-keeping requirements (see our USC 2257 Statement)
You comply with all applicable tax obligations in your jurisdiction
You have read and agree to the Content Creator Agreement

7. Payment Terms

All prices on the Platform are displayed in EUR (€). Payments are processed through our authorised payment providers (Payrexx for card payments, NowPayments for cryptocurrency). The Platform charges a commission on Creator earnings as set out in the Content Creator Agreement. Withdrawals are subject to minimum thresholds, KYC verification, and processing times as detailed in your account settings.

8. Intellectual Property

You retain ownership of all content you create and post on the Platform. By posting content, you grant Zumido GmbH a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform. This licence terminates when you delete your content or account, except where copies are required for legal or regulatory purposes.

9. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose
Attempt to circumvent any security measures or access controls
Scrape, crawl, or use automated tools to collect data from the Platform
Impersonate any person or entity
Redistribute, resell, or publicly share any content obtained through the Platform
Use the Platform to harass, threaten, or intimidate other users
Create multiple accounts to evade bans or restrictions

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice where the violation is serious. You may delete your account at any time through your account settings. Upon termination, any outstanding Creator earnings will be paid out in accordance with the Content Creator Agreement, subject to any legal holds.

11. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by Swiss law, Zumido GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total aggregate liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Zumido GmbH, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

13. Dispute Resolution

These Terms are governed by the laws of Switzerland, without regard to its conflict of law provisions. Any dispute arising from these Terms shall first be attempted to be resolved through our Complaints Policy. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Platform at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Platform and close your account.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
