Contract between Fan and Creator

This document sets out the terms of the agreement between a Fan and a Creator when the Fan makes a payment to access a Creator's content or services on the Zumido platform ("the Platform"). Zumido GmbH ("Zumido") acts as an intermediary facilitating this contract but is not itself a party to it.

1. Formation of Contract

A contract is formed between the Fan and the Creator at the moment the Fan completes a transaction (subscription, tip, pay-per-view payment, service purchase, or other payment) through the Platform. By completing a transaction, the Fan agrees to these terms.

2. What the Fan Receives

• Subscriptions: Access to the Creator's subscriber-only content for the subscribed period (monthly, quarterly, semi-annual, or annual). Access continues until the end of the paid period, even if the subscription is cancelled
• Pay-per-view: Permanent access to the specific unlocked content for as long as it remains on the Platform and the Creator's account is active
• Tips: Tips are voluntary payments. They do not entitle the Fan to any specific content or service unless explicitly agreed by the Creator
• Services: The specific deliverable described in the Creator's service listing, within the stated delivery timeframe
• Live streams: Access to view the Creator's live stream or recorded VOD as specified at the time of purchase

3. Pricing

All prices are displayed in EUR (€) and include any applicable taxes. The price displayed at the time of purchase is the price the Fan will be charged. Creators may change their pricing at any time, but changes do not affect existing subscriptions until the next renewal period.

4. Payment Processing

Payments are processed by Zumido's authorised payment providers on behalf of the Creator. Zumido collects the payment, deducts its platform commission, and remits the remaining amount to the Creator. The Fan's payment obligation is fulfilled when the payment is successfully processed by the payment provider.

5. Subscription Auto-Renewal

Subscriptions auto-renew by default at the end of each billing period at the then-current subscription price. Fans may disable auto-renewal at any time through their account settings. Disabling auto-renewal does not affect access for the current paid period.

6. Cancellation and Refunds

• Subscriptions: Fans may cancel at any time. Access continues until the end of the current billing period. No pro-rata refunds are provided for partial periods
• Pay-per-view and tips: These transactions are final and non-refundable once the content has been delivered or accessed
• Services: Refund eligibility depends on delivery status. If the Creator fails to deliver within the agreed timeframe, the Fan may request a refund through our support team
• Exceptional circumstances: Zumido may issue refunds at its discretion in cases of fraud, technical errors, or where a Creator's account is terminated for policy violations

7. Creator's Obligations

The Creator agrees to:

• Provide the content or services as described at the time of purchase
• Maintain an active account and continue to make subscribed content available
• Not delete or restrict access to content that Fans have paid to access, except where required by law or Zumido's policies
• Fulfil service orders within the stated delivery timeframe

8. Fan's Obligations

The Fan agrees to:

• Not redistribute, resell, screenshot, record, or publicly share any content accessed through the Platform
• Respect the Creator's intellectual property rights
• Not harass, threaten, or abuse Creators
• Not initiate fraudulent chargebacks

9. Content Availability

While Creators are expected to maintain access to purchased content, Zumido does not guarantee perpetual availability. Content may become unavailable if the Creator deletes it, closes their account, or if it is removed for policy or legal reasons. Zumido is not liable for content that becomes unavailable.

10. Zumido's Role

Zumido acts solely as an intermediary. We facilitate the transaction and provide the technical infrastructure but are not responsible for the quality, accuracy, or legality of Creator content. Disputes between Fans and Creators should be raised through our Complaints Policy.

11. Governing Law

This contract is governed by Swiss law. Disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland, without prejudice to any mandatory consumer protection rights applicable in the Fan's country of residence.
