Content Creator Agreement

This Content Creator Agreement ("Agreement") is entered into between you ("Creator", "you") and Zumido GmbH, a company incorporated in Switzerland ("Zumido", "we", "us"). This Agreement governs your use of the Zumido platform ("the Platform") as a content creator and supplements our Terms and Conditions.

1. Eligibility

To become a Creator on the Platform, you must:

Be at least 18 years old
Successfully complete identity verification (KYC) through our approved provider
Provide accurate and truthful information during registration and verification
Accept these terms, the Terms and Conditions, and the Community Guidelines

2. Content Ownership and Licence

You retain full ownership of all content you create and post on the Platform. By posting content, you grant Zumido a non-exclusive, worldwide, royalty-free licence to:

Host, store, display, and deliver your content to authorised users through the Platform
Create thumbnails, previews, and transcoded versions of your content for technical purposes
Use your profile name, avatar, and bio in promotional materials for the Platform (you may opt out by contacting support)

This licence terminates when you delete your content or account, except where copies must be retained for legal or regulatory purposes.

3. Creator Obligations

As a Creator, you agree to:

Comply with the Community Guidelines at all times
Ensure all individuals in your content are over 18 and have given informed consent
Maintain age verification records for all individuals appearing in your content, in compliance with applicable record-keeping laws (see USC 2257 Statement)
Accurately describe and price your content and services
Fulfil service orders within the stated delivery timeframe
Comply with all applicable tax laws in your jurisdiction, including declaring income earned through the Platform
Not engage in fraudulent or deceptive practices
Not attempt to circumvent the Platform's payment system

4. Revenue and Commission

Zumido charges a platform commission on all Creator earnings. Your effective commission rate is displayed in your account settings. The default commission rate is set at the time of account creation and may be adjusted individually. Revenue is calculated as follows:

Creator Earnings = Gross Transaction Amount − Platform Commission

Commission applies to all transaction types: subscriptions, tips, pay-per-view, service purchases, and message fees.

5. Payouts

Minimum withdrawal: As displayed in your Payout Settings
Payout methods: Bank transfer (SEPA) or cryptocurrency, as configured in your account
Processing time: Payout requests are processed in regular batches. Processing times vary by method
Verification: Withdrawal requests require OTP verification for security
Tax withholding: Zumido does not withhold taxes. You are solely responsible for all tax obligations in your jurisdiction

6. Content Removal

We reserve the right to remove content that violates our policies without prior notice. For serious violations (CSAM, trafficking, non-consensual content), removal is immediate and may be accompanied by account termination and law enforcement referral. For other violations, we will generally provide notice and an opportunity to correct the issue before removal.

7. Account Suspension and Termination

We may suspend or terminate your Creator account for:

Violation of these terms, the Terms and Conditions, or Community Guidelines
Failure to maintain valid KYC verification
Suspected fraudulent activity
Extended inactivity (12+ months with no content or login)
Legal or regulatory requirement

Upon termination, any earned but unpaid balance will be paid out within 30 days, subject to any legal holds or fraud investigations. If termination is due to policy violations, we reserve the right to withhold payouts pending investigation.

8. Voluntary Departure

You may close your Creator account at any time through your account settings. Upon closure:

Active subscriptions will not be renewed but will remain accessible until the end of their paid period
Your content will be removed from the Platform
Any outstanding balance will be paid out subject to the minimum withdrawal threshold

9. Representations and Warranties

You represent and warrant that:

All content you post is original or you hold all necessary rights and licences
Your content does not infringe any third party's intellectual property rights
All individuals in your content are adults who have given informed consent
You are not subject to any sanctions or legal restrictions that would prevent you from using the Platform

10. Indemnification

You agree to indemnify and hold harmless Zumido GmbH, its officers, directors, and employees from any claims, damages, or expenses arising from your content, your breach of this Agreement, or your violation of any law or third-party rights.

11. Changes to This Agreement

We may update this Agreement from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Platform as a Creator after changes take effect constitutes acceptance.

12. Governing Law

This Agreement is governed by Swiss law. Disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
